An Islamic court has ordered an unmarried couple to be caned for trying to have sex in a car in the latest of a series of harsh punishments for Muslims in Malaysia, a lawyer said Friday.
Though Malaysia has long been upheld as an example of a moderate Muslim-majority country, recent verdicts sentencing Muslims to whipping for drinking alcohol have made headlines.
Two months ago, an Islamic judge triggered a national debate when he ordered a woman to be caned for drinking beer.
In the latest case, the Shariah High Court in central Selangor state sentenced the couple Wednesday to six strokes of the cane after they pleaded guilty to trying to have sex out of wedlock in their car, said prosecutor Shafezan Rusli.
Shafezan said Islamic religious police caught Mohamad Shahrin Abdul Majid, 29, and Nadiah Najat Hussin, 24, with only their undergarments on in a car at an office parking lot in May.
He said they are appealing the caning as they plan to get married soon, though they have paid the court-ordered fine of 5,000 ringgit ($1,400) each.
They could have been jailed for up to three years for the offense, the lawyer said.
Shariah laws apply to Muslims, who make up about 60 percent of the 28 million population, in all personal matters. Non-Muslims _ Chinese, Indians and other minorities _ are not subject to the laws.
Earlier this week, an Islamic court in another state ordered an Indonesian Muslim man to be whipped six times and jailed a year for drinking liquor at a restaurant.
In July, the same court had sentenced a Malaysian woman to six strokes of the cane and a fine for drinking beer in public. The caning, which would be the first time a Malaysian woman has received the punishment, has not been carried out yet.
Many see the sentence as a setback for the country's reputation as a moderate Muslim nation.

Six cane strokes await the waitress who served beer to Malaysian part-time model Kartika Sari Dewi Shukarno. The model was earlier sentenced for drinking in public by an Islamic court.
The waitress who has not been named was fined RM 5,000 ($ 1,429) and six strokes of cane.
These are the first two cases of women being sentenced to caning in Malaysia where Muslims are forbidden from drinking in public as per the Shariah law.
The waitress, who pleaded guilty, has appealed. A verdict is awaited, The Star said Wednesday.

Leave these girls alone - they are doing a job - if they do not do it, they get screwed by their bosses or the customer, if they do it, they get screwed by the 'religious' cops who have nothing else to do but to go around preying on innocent victims.
These religious policemen should be stationed at the right places - to nab the rempits since they are so adept at nabbing offenders. After much speculation over the identity of the MIC member who had called for the portrait of Tun Dr Mahathir Mohamad to be garlanded with slippers, it is now revealed that the person was none other than MIC’s Paya Besar division deputy chairman Peter Sugumaran.
And after his initial bluster, all he wants now is to say sorry to the former prime minister.
“What I want to say is, Dr Mahathir, I am sorry for demeaning you,” he told Malay Mail in a telephone interview yesterday.
Sugumaran admitted that the decision was a bad call on his part and expressed remorse over the incident. “In the heat of the moment, I didn’t know what I was talking about,” he said.
“The words just came out of my mouth. I didn’t plan it when I went onstage to say my piece,” said the retired Tenaga Nasional Berhad employee.
Recalling the incident during the party’s presidential debate on Sunday, Sugumaran said that halfway through his speech, MIC president Datuk Seri S. Samy Vellu got up and stopped him in his tracks, telling him not to criticise Dr Mahathir.
However, when asked to clarify allegations by several party members that he had allegedly, the night before his speech, declared his intention to criticise Dr Mahathir when he took to the stage, Sugumaran replied in the affirmative.
“It’s true. I did tell several delegates that I wished to speak my mind on outside interference but I didn’t mean to put down the great leader,” he said.
The three-term division deputy chief said he was prepared to face any action deemed fit by the party disciplinary committee over his action and reiterated his regret over the incident.
“Upon realising my mistake, I apologised to the president. I also conveyed the same message to my State chairman Datuk Davendran Murthy,” said Sugumaran.
When contacted, Davendran, the Sabai State assemblyman, said he was surprised that Sugumaran could suggest such a thing (about Dr Mahathir).
“I’ve known him a long time. He’s a well-mannered person and not usually the kind of man to do such a thing.”
Earlier yesterday, Samy Vellu announced Sugumaran’s suspension with immediate effect for suggesting that a garland of slippers be placed on Dr Mahathir’s photograph at PWTC, the venue of the MIC general assembly last weekend.
He said the party would wait for the recommendations of the disciplinary committee to the Central Working Committee (CWC) before deciding on any further action.
The disciplinary committee has to issue a show-cause letter asking the delegate to provide an explanation. The party’s constitution provides for the disciplinary committee to warn, suspend or sack a member, but its decision has to be endorsed by the CWC.
“I hope with this decision, the issue would be put to rest,” Samy Vellu said.
He said that he had also discussed the issue with other senior leaders in the party and they agreed with the suspension.
MIC vice-president Datuk Dr S. Subramaniam said he agreed with the suspension.
“We do not condone the delegate’s action as it is against Indian culture and (standards of) civility,” he said in a statement.
Dr Subramaniam said other delegates had also condemned the delegate’s remarks during the debate. The “garland of slippers” suggestion came after some MIC members got upset with Dr Mahathir, who was quoted by the Makkal Osai Tamil daily as saying that Samy Vellu had done nothing for the Indian community and that he had “stayed too long”.
Samy Vellu first criticised the former premier for interfering in internal party matters, but said he opposed the garland suggestion and would take disciplinary action against the delegate.

Samy Vellu and candidates aligned to him swept the board in a demonstration of his iron-grip on the MIC. But the veteran leader is finding it hard to contain the anti-MIC rhetoric from Umno that followed the “garland of slippers” incident.
He took action against Peter Sugumaran, the delegate from Paya Besar division in Pahang, yesterday but his supporters have moved to the frontline to ward off attacks against him.
Said political analyst Dr Ravindran Savrimuthu: “Samy Vellu may have sacked the delegate in the hope that the matter would be put to rest.
“But he would be fully aware that only a personal apology to Dr Mahathir would bring an end to the issue.”
Ravindran said Samy Vellu should abandon his “tough guy” stance in this case in the larger interest of the BN.
Umno leaders and a variety of BN leaders have described the “garland of slippers” suggestion as rude, excessive and extreme.
They said BN members must show that they respected others, respected leaders and were individuals who valued culture and tradition and upheld decorum in the coalition.

MIC Youth leader T. Mohan now wants Umno to take disciplinary action against former prime minister Tun Dr Mahathir Mohamad since the Pahang delegate who made the disparaging remarks against Dr Mahathir has been suspended.
Mohan said neither he nor the party condoned the “garland of slippers” suggested by Peter Sugumaran of the MIC Paya Besar division in Pahang.
However, the Youth wing feels the former prime minister should not have interfered in the internal affairs of the MIC, he said.
“Much as both the party and I hold Dr Mahathir in high esteem, action should be taken against him by Umno for interfering in the affairs of the MIC.”
Mohan said Dr Mahathir should not have hit out against party president Datuk Seri S. Samy Vellu when a tight fight for the MIC positions was around the corner.
He said statements made by the influential Dr Mahathir were uncalled for and had upset members who viewed them as a move to oust Samy Vellu.
He said it was not the first time during precarious moments that Dr Mahathir had done so. “MIC members have not forgotten Dr Mahathir’s statement just two days before the 2008 general election when he condemned the party president for not having done anything for the Indian community.
“Although the MIC candidates lost in most of the constituencies, the MIC members tolerated and refrained from making any counter-attack on Dr Mahathir for his accusations.”
Mohan was elaborating on his statement to Samy Vellu-owned Tamil Nesan daily yesterday. He said while he had discouraged the suspended delegate, Peter Sugumaran, from making the proposal during his speech on the presidential debate on Sunday, MIC delegates had the right to criticise Dr Mahathir or anyone who intervened in “our internal matters”.
Dr Mahathir had given his views on the MIC, Samy Vellu and endorsed Datuk S. Subramaniam as the deputy president of the party and the one to regain Indian support for the Barisan Nasional.
This angered several MIC members who rushed to the defence of Samy Vellu, including Sugumaran who mentioned in his speech on the presidential debate that a garland of slippers be placed on the portrait of Dr Mahathir at PWTC, home of Umno.
Umno leaders hit back, describing the “garland of slippers” suggestion as rude, excessive and extreme.
Samy Vellu first criticised the former premier for interfering in internal party matters, but said that he had been against the garland suggestion and would take disciplinary action against the delegate.
Asked if the MIC would issue a personal apology to Dr Mahathir as Umno leaders have taken umbrage over the remark and have demanded a personal apology from Samy Vellu, Mohan said: “It’s up to the individual to apologise.”
He said he hoped the storm would blow over despite the conflicts over comments made by other MIC leaders responding to the demand for a personal apology.

Since 'slipper man' has been suspended, Umno must take disciplinary action against former premier

MIC Youth leader T. Mohan now wants Umno to take disciplinary action against former prime minister Tun Dr Mahathir Mohamad since the Pahang delegate who made the disparaging remarks against Dr Mahathir has been suspended.
Mohan said neither he nor the party condoned the “garland of slippers” suggested by Peter Sugumaran of the MIC Paya Besar division in Pahang.
However, the Youth wing feels the former prime minister should not have interfered in the internal affairs of the MIC, he said.
“Much as both the party and I hold Dr Mahathir in high esteem, action should be taken against him by Umno for interfering in the affairs of the MIC.”
Mohan said Dr Mahathir should not have hit out against party president Datuk Seri S. Samy Vellu when a tight fight for the MIC positions was around the corner.
He said statements made by the influential Dr Mahathir were uncalled for and had upset members who viewed them as a move to oust Samy Vellu.
He said it was not the first time during precarious moments that Dr Mahathir had done so. “MIC members have not forgotten Dr Mahathir’s statement just two days before the 2008 general election when he condemned the party president for not having done anything for the Indian community.
“Although the MIC candidates lost in most of the constituencies, the MIC members tolerated and refrained from making any counter-attack on Dr Mahathir for his accusations.”
Mohan was elaborating on his statement to Samy Vellu-owned Tamil Nesan daily yesterday. He said while he had discouraged the suspended delegate, Peter Sugumaran, from making the proposal during his speech on the presidential debate on Sunday, MIC delegates had the right to criticise Dr Mahathir or anyone who intervened in “our internal matters”.
Dr Mahathir had given his views on the MIC, Samy Vellu and endorsed Datuk S. Subramaniam as the deputy president of the party and the one to regain Indian support for the Barisan Nasional.
This angered several MIC members who rushed to the defence of Samy Vellu, including Sugumaran who mentioned in his speech on the presidential debate that a garland of slippers be placed on the portrait of Dr Mahathir at PWTC, home of Umno.
Umno leaders hit back, describing the “garland of slippers” suggestion as rude, excessive and extreme.
Samy Vellu first criticised the former premier for interfering in internal party matters, but said that he had been against the garland suggestion and would take disciplinary action against the delegate.
Asked if the MIC would issue a personal apology to Dr Mahathir as Umno leaders have taken umbrage over the remark and have demanded a personal apology from Samy Vellu, Mohan said: “It’s up to the individual to apologise.”
He said he hoped the storm would blow over despite the conflicts over comments made by other MIC leaders responding to the demand for a personal apology.
Asked if his comments would worsen the situation, Mohan said: "We have to stand our ground. We can’t keep quiet just because he was the former prime minister.”

(The Malay Mail) THE 12 people to be charged in court this morning for the controversial 'cow-head' incident on Aug 26 are expected to plead that their intentions to conduct the protest that day had been misconstrued and had been unfairly turned into a religious issue.
Kamarul Irzuan, one of the lawyers representing the 12 to be charged, also said that his clients had told him that they don't know who even brought the cow head in the first place as it was never part of their plans.

"None of my clients brought the cow head as it had nothing to do with the main messages (?)they wanted to send in their memorandum to the Selangor State government."
Kamarul said the main grouse was that the Section 23 Shah Alam residents felt aggrieved the State government had decided to locate a Hindu temple within the mainly Muslim community without even consulting them first.
"There isn't anything religious or racial about such a concern because there are hardly any Hindus here in the first place and why would anyone want to inconvenience them to come to a strange new place? The residents wanted the State government to explain this rationale."
Kamarul further said that the Section 23 residents also wanted to know why the Hindu temple was being relocated in the first place since there didn't seem to be any real reason for it to be moved.
"The residents felt it was an arbitrary decision that was unfair to both Hindus and Muslims, and wanted the State government to reconsider as the decision seemed very high-handed."
He spoke to Malay Mail after the 12 were summoned to the Shah Alam district police headquarters at 9pm yesterday. After being questioned, all 12 were released on personal bonds at 12.30am and were instructed to appear at the Shah Alam Sessions Court at 9am today.
Kamarul said the 12 had yet to be told what charges they would be facing, but he expected all to be charged for illegal assembly under Section 27 of the Police Act.
He also expected six of them to be charged under Section 1 and Section 4 of the Sedition Act, and felt that it would be unfair for this charge to be made.
Kamarul also drew a comparison to the recent case of a pig head that was dumped at the Universiti Malaya surau in January. The carcass had been placed in a Pas flag in a surau located in the Islamic studies academy.
"What happened in that case?" he asked.
"Why was there no big legal controversy like what is happening now? Furthermore, my clients had no religious extremism in mind when they did what they did. Is it fair then that they are persecuted for something they had never intended?"

I had to remind myself many times that this was happening during Ramadan, when we are enjoined to exercise restrain. Did these people then go home and eat since surely their puasa was batal'd?

I grew up in Kedah and Kedahans, while not an overly formal people, put great store on courtesy and manners. Known for being gentle people, we were governed by many rules on how we behaved and spoke, particularly to our elders.
For instance, it was considered extremely impolite to refer to ourselves as 'saya' (I) when speaking to family members (including extended family members). 'Saya' was considered so formal as to be snobby, even arrogant. (The extremely informal 'aku' however was beyond the pale; you only use it among very close friends who are allowed to call you the very rough 'hang'). Correctly speaking, you have to refer to yourself always by name, or at least the diminutive version of it, or, as some very traditional Kedah women would, as 'Che' (pronounced 'Chek', not 'Chay') though this is considered very 'manja'. Thus you would say, "Che tak tau la sapa mai tadi pasai Che tak dak kat rumah." (I don't know who came just now because I was not home.)
Similarly, having to name one's parents posed great difficulties to the well-brought up Kedahan. Our parents' names were sacred, not to be bandied about. Perhaps it was a way of teaching us not to be arrogant about our family and origins. But if asked what our parents' names were, the reaction was often a certain amount of blushing and hand-wringing before a tiny voice finally whispered their names.
This was the way I grew up. And to this day I treat my elders with respect, even when I don't like them too much. I may now find it easier to refer to myself as 'saya' when I speak to someone in KL though I tend to retreat to the English 'I' when I can. Also, even 12 years after receiving my award from the Sultan of Selangor, I cannot bring myself to introduce myself by my title nor sign off anything but the most formal of letters with it.It's the Kedah way and what my parents taught me.
Not to say that Malays from other states are any less polite. We stick to many rules of courtesy. One of those I like is calling someone older than you 'Kak' or 'Abang' or 'Makcik/Aunty' or 'Pakcik/Uncle'.I still inwardly cringe when a young person calls me by my name although I have made it a rule that if they're over 25, they don't have to call me Aunty. And those who do call me Aunty aren't allowed to shout it out too loudly in public. But it's nice when, unbidden, young people easily address you as Kak or Aunty as a show of respect. It also tells you a lot about their upbringing.
Why am I talking about upbringing? It's really been prompted by that video I posted yesterday on the Shah Alam dialogue-turned-fracas. Over the years I have become aware that civility is really becoming uncool. People are rude everywhere, whether on the roads, in shops ( you know, the ubiquitous and automatic 'no stock' without even bothering to look) or on the phone.Most of it is shrugged off as the daily irritations of city life and frankly sometimes on a bad day I can be curt too.

This goes beyond being rude. It is plain religious/racial bigotry. Being rude is part of being a Malaysian. But racism here is catching up at a rate no one anticipated.
Imagine nothing being done about what happened. Imagine the slimeballs sitting 'left' and 'right' of yet another hypocritical keris waving racist.
These people had no qualms about the sentiments of people of another religion. And mind you, one idiot is a 'haji' - what did he do when he went to Mecca to perform his Haj or the Umrah pilgrimage?
These morons came out of the usual Friday prayers and hit the streets just like that haji who came back from the Holy Land and began his diabolical act.
I do not call it being rude. I call it being BARBARIC. These are tribal people who left their half-baked brains in the alley then marched on the streets.
If they can disrespect their own kind - an MB, then who do you think they respect ( other than BN/UMNO )?
These kind of people's staple diet is shit and shit comes out of their foul mouth. Garbage in, garbage out.
