COW HEAD CONTROVERSY: Sedition charge unfair, says lawyer

(The Malay Mail) THE 12 people to be charged in court this morning for the controversial 'cow-head' incident on Aug 26 are expected to plead that their intentions to conduct the protest that day had been misconstrued and had been unfairly turned into a religious issue.

Kamarul Irzuan, one of the lawyers representing the 12 to be charged, also said that his clients had told him that they don't know who even brought the cow head in the first place as it was never part of their plans.

 "None of my clients brought the cow head as it had nothing to do with the main messages (?)they wanted to send in their memorandum to the Selangor State government."

Kamarul said the main grouse was that the Section 23 Shah Alam residents felt aggrieved the State government had decided to locate a Hindu temple within the mainly Muslim community without even consulting them first.

"There isn't anything religious or racial about such a concern because there are hardly any Hindus here in the first place and why would anyone want to inconvenience them to come to a strange new place? The residents wanted the State government to explain this rationale."

Kamarul further said that the Section 23 residents also wanted to know why the Hindu temple was being relocated in the first place since there didn't seem to be any real reason for it to be moved.

"The residents felt it was an arbitrary decision that was unfair to both Hindus and Muslims, and wanted the State government to reconsider as the decision seemed very high-handed."

He spoke to Malay Mail after the 12 were summoned to the Shah Alam district police headquarters at 9pm yesterday. After being questioned, all 12 were released on personal bonds at 12.30am and were instructed to appear at the Shah Alam Sessions Court at 9am today.

Kamarul said the 12 had yet to be told what charges they would be facing, but he expected all to be charged for illegal assembly under Section 27 of the Police Act.

He also expected six of them to be charged under Section 1 and Section 4 of the Sedition Act, and felt that it would be unfair for this charge to be made.

Kamarul also drew a comparison to the recent case of a pig head that was dumped at the Universiti Malaya surau in January. The carcass had been placed in a Pas flag in a surau located in the Islamic studies academy.

"What happened in that case?" he asked.

"Why was there no big legal controversy like what is happening now? Furthermore, my clients had no religious extremism in mind when they did what they did. Is it fair then that they are persecuted for something they had never intended?"

KUALA LUMPUR: Home Minister Datuk Seri Hishammuddin Hussein has “cleared” the Prisons Department to cane part-time model Kartika Sari Dewi Shukarno.

Hishammuddin had recently said the ministry needed to study the proper procedures before caning the woman according to Syariah law, adding that he would not allow the department to execute the caning sentence if it did not have the knowledge and expertise to do it.

Seems to be very thoughtful. Proper procedures, call an expert, cane lightly, make sure sarong is on, have knowledge about the anatomy and the exact place to cane - 6 times....same spot 6 times.

Syariah Law? Syariah Law says you should cane a young mother of 2 for drinking beer? If that is true then I say, we do not need such a 'law' because it is of my opinion that this kind of punishment is prehistoric and that kind of court is decrepit.

Don't these primitive predators realize that Kartika has to endure the indignity of this ignominy meted by mere shady characters throughout her life? All because of drinking beer?

Why pick on this one particular woman when there are so many out there consuming beer and alcohol, indulging in drugs and plain reckless rempits on the rage etc? She said "no" to some hotshot? There's more to it than Kartika drinking beer.

The End of Civility?

I had to remind myself many times that this was happening during Ramadan, when we are enjoined to exercise restrain. Did these people then go home and eat since surely their puasa was batal'd?

I grew up in Kedah and Kedahans, while not an overly formal people, put great store on courtesy and manners. Known for being gentle people, we were governed by many rules on how we behaved and spoke, particularly to our elders.

For instance, it was considered extremely impolite to refer to ourselves as 'saya' (I) when speaking to family members (including extended family members). 'Saya' was considered so formal as to be snobby, even arrogant. (The extremely informal 'aku' however was beyond the pale; you only use it among very close friends who are allowed to call you the very rough 'hang'). Correctly speaking, you have to refer to yourself always by name, or at least the diminutive version of it, or, as some very traditional Kedah women would, as 'Che' (pronounced 'Chek', not 'Chay') though this is considered very 'manja'. Thus you would say, "Che tak tau la sapa mai tadi pasai Che tak dak kat rumah." (I don't know who came just now because I was not home.)

Similarly, having to name one's parents posed great difficulties to the well-brought up Kedahan. Our parents' names were sacred, not to be bandied about. Perhaps it was a way of teaching us not to be arrogant about our family and origins. But if asked what our parents' names were, the reaction was often a certain amount of blushing and hand-wringing before a tiny voice finally whispered their names.

This was the way I grew up. And to this day I treat my elders with respect, even when I don't like them too much. I may now find it easier to refer to myself as 'saya' when I speak to someone in KL though I tend to retreat to the English 'I' when I can. Also, even 12 years after receiving my award from the Sultan of Selangor, I cannot bring myself to introduce myself by my title nor sign off anything but the most formal of letters with it.It's the Kedah way and what my parents taught me.

Not to say that Malays from other states are any less polite. We stick to many rules of courtesy. One of those I like is calling someone older than you 'Kak' or 'Abang' or 'Makcik/Aunty' or 'Pakcik/Uncle'.I still inwardly cringe when a young person calls me by my name although I have made it a rule that if they're over 25, they don't have to call me Aunty. And those who do call me Aunty aren't allowed to shout it out too loudly in public. But it's nice when, unbidden, young people easily address you as Kak or Aunty as a show of respect. It also tells you a lot about their upbringing.

Why am I talking about upbringing? It's really been prompted by that video I posted yesterday on the Shah Alam dialogue-turned-fracas. Over the years I have become aware that civility is really becoming uncool. People are rude everywhere, whether on the roads, in shops ( you know, the ubiquitous and automatic 'no stock' without even bothering to look) or on the phone.Most of it is shrugged off as the daily irritations of city life and frankly sometimes on a bad day I can be curt too.

This goes beyond being rude. It is plain religious/racial bigotry. Being rude is part of being a Malaysian. But racism here is catching up at a rate no one anticipated.

Imagine nothing being done about what happened. Imagine the slimeballs sitting 'left' and 'right' of yet another hypocritical keris waving racist.

These people had no qualms about the sentiments of people of another religion. And mind you, one idiot is a 'haji' - what did he do when he went to Mecca to perform his Haj or the Umrah pilgrimage?

These morons came out of the usual Friday prayers and hit the streets just like that haji who came back from the Holy Land and began his diabolical act.

I do not call it being rude. I call it being BARBARIC. These are tribal people who left their half-baked brains in the alley then marched on the streets.

If they can disrespect their own kind - an MB, then who do you think they respect ( other than BN/UMNO )?

These kind of people's staple diet is shit and shit comes out of their foul mouth. Garbage in, garbage out.

As long as we have such uncouth scumbags (inc BN/UMNO) we will never have a multi-racial harmonious Malaysia.

Btw Marina, these hoodlums make PAS look like a Tame party. The truth of the matter is, PAS still has that temple although there are not many Hindus attending prayers there.

As such, puasa is alien to them. They have no right to claim that they are fasting.
They have no right to claim Islam is their religion.

These animals are not Muslims like you and all Muslims who condemn this evil act.

Celina Speaks on DEMOCRACY


On celebration of our 62nd year of Independence, I write today as a fourth generation Indian army daughter and not Celina Jaitly.

We have come a long way and this Independence Day I specially dedicate what I write, to all the soldiers of the great Indian Army, because the courage, strength and determination with which I stand today as a young woman runs in my veins from a very brave lineage of warriors who fought for the integrity and security of this country. The only difference is I am fighting the enemy which is gnawing at the very roots of this democracy from within.

The babas and yogis and many others self appointed “theckedars of society”, who have scorned me and assassinated my character and questioned “who” gave me (just an actress) the right to stand up for causes of society. Well, four generations of my family’s blood has gone into the service of this nation for nothing in return but a few medals... I HAVE THE RIGHT BLOODY WELL MORE THAN ANYONE ELSE to protect the legacy from within and for which these brave men have given their lives without a single complaint but a smile in the face of the enemy’s bayonet .

I pledge this Independence Day that I will not allow anyone to gnaw at the roots of this great democracy. I will not let anyone stand in the way of human dignity, human rights...

. Right to equality
. Right to freedom
. Right against exploitation
. Right to freedom of religion
. Cultural and educational rights
. Right to constitutional remedies

... There is nothing more powerful then citizen action to combat corruption. This Independence Day I would like to say again that everybody thinks of changing humanity but nobody thinks of changing themselves. Change your attitude from within (for any cause) and your support is shown.

From a citizens’ rights point of view, the solution to all our complaints is to view them as your and my responsibility... not that of governments, the police and multinational companies. “You and I” should play our part if we want things to happen in our interest... in the citizens’ interest ... our biggest complaint is corruption and the only way to fight corruption is if we the people are willing to stand in line, wait for our turn and follow normal procedures to get service. Do not be afraid to stand up and voice your opinion, know your rights. There are enough fundamental rights to protect us... Use your power of vote... it’s all about the first step... take it.

This Independence Day is also the celebration of India on its way to becoming a complete true democracy. This year has seen the victory of a very small minority which has been living behind the bars of a colonial relic of a law... yes my friends, the LGBT community. I want to specify once again that giving the sexual minorities their rights does not diminish your own. It’s not about gay rights, it’s about human dignity and basic human rights.

This Independence Day I shall walk hand in hand with the community on August 16th at the very first non-criminally yours ‘GAY PRIDE’... a walk of the community whose very alternate choice of living was a criminal offence for the last 160 years.

Our country got it’s independence but some people within this country were still not free, independent and their fight for dignity has been the longest. People like Ashok Row Kavi spent most of their life in this endeavour and are the unsung heroes of this struggle for Independence. I also applaud brave women like Lakshmi and Gita Kumana who dared to fight all and stand up for themselves and all like them.

The first Independence Day speech was made by Jawaharlal Nehru. It is known as “Tryst with Destiny”. The speech was made to the Indian Constituent Assembly on the eve of India’s independence, towards midnight on August 14, 1947. And for all the people who found their freedom only now, I would like to put the following lines which are very famous from his historical speech–

“A moment comes, which comes but rarely in history, when we step out from the old to the new, when an age ends, and when the soul of a nation, long suppressed, finds utterance. It is fitting that at this solemn moment we take the pledge of dedication to the service of India and her people and to the still larger cause of humanity...”

I feel and speak on behalf of the entire LGBT community happily that now with rights for all we can all work together for the betterment of our beloved country. Let us forget caste, creed, sexuality, religion... let us be one for the betterment of us all, for the betterment of our nation. As Gurudev Rabindranath Tagore said in his most famous poem, “Where the mind is without fear/And the head is held high/Into that heaven of freedom, my Father/Let my country awake...”

Good for you Celina. You put to shame the warped minds of some people in this country. You are a beauty with brains which is more than I can say about our local morons - no beauty and no brains. This is the ugly side of Malaysia. You will know who they are - if you already do not. Yet we promote the world renowned commercial .... Malaysia Truly Asia!

We too have come a long way from Independence Day .... but have a longer way to go towards achieving democracy.

We have our very own self appointed 'babas' and 'yogis' too - the "thekedars of society" as you aptly stated, who are tring so hard and resorting to surrepticious ways to silence the Peoples' voice. These are people with insidious intents.

We too have the bloody right to voice our opinions without having the draconian ISA Internal Security Act ) hovering above us each time we voice our disatisfaction of the lack of governance in general. We are fighting to abolish that too.

We had an anti-ISA rally not long ago but the police were quick to act .... contrary to a timid and 'peaceful' police force when a cow's head was displayed in protest of an Indian temple being in a 'Malay majority' area.

And the new PM calls this country 1Malaysia! I am still in a daze as to what this 1Malaysia is all about and for which race it is for. Many of us are.

But you see Celina, the present regime is infested with cockroaches - After our frist Prime Minister all hell broke loose.

In a place where the vast majority are Hindus, India seems to be handling the religious issues very well as compared to a Muslim majority country like ours - where the non-Muslims are subject to the Malay Supremacy.

We are considered 'pendatangs' or immigrants. But they fail to understand where they came from.

"Things Fall Apart, the center never holds ( in this case ) and mere anarchy is loosed upon the world."

Corruption is rampant. But little is done for obvious reasons.

Permit me to quote what you said. I think this is one quotation that is a valuable lesson for all the citizens of this country.
